Appellant seeks reversal of a decision by the Des Moines Independent Community School District (CSD) school board denying a timely-filed open enrollment request on behalf of her minor child, N.H.

The Des Moines Independent Community School District denied Appellant's open enrollment request on the basis of its voluntary diversity plan, in accordance with Iowa Code section 282.18(3). Appellee asserts that, under this section, the proper avenue for appealing the district's decision is to the Iowa District Court for Polk County and not the State Board of Education.

ALJ concluded that the State Board has no jurisdiction to hear this appeal and granted the Appellee motion to dismiss.
