Summary

Appellant seeks reversal of a decision by the Des Moines Independent Community School District Roosevelt Activities Appeal committee (AAC) terminating student's eligibility for the remainder of the swimming season.

The Des Moines Independent Community School District clearly outlined its process regarding good conduct violations in its Good Conduct Policy which provides that initial decisions regarding violations are made by the Activities Director. If parties are not satisfied with the decision of the Activities Director, they have the option to appeal to the AAC. The decision of the AAC is final, and there is no further right to appeal.

Appellee filed a motion to dismiss citing lack of jurisdiction.

The ALJ concluded that the State Board has no jurisdiction to hear this appeal and granted the Appellee's Motion to Dismiss.
